This Privacy Policy applies to the websites, social media pages, mobile applications, or online services that are owned or controlled by Nature’s Way Brands, LLC and its subsidiaries (collectively, “Nature’s Way,” “our,” “we,” or “us”) and that post a link to this Privacy Policy (collectively, “Sites,” and individually, a “Site”). This Privacy Policy only covers information collected at the Sites and does not cover information collected at any other website or offline by Nature’s Way, unless specifically stated. This Privacy Policy describes our information collection, use, disclosure, retention, and protection practices, as well as privacy rights that may be available to you under applicable U.S. state privacy laws.

This Privacy Policy does not apply to any other website owned or operated by any third party even if such third party links to a Site or if Nature’s Way links to that third-party website. Accordingly, this Privacy Policy does not apply to the practices of any third party or business partner that Nature’s Way does not own or control. Your use of this website is also governed by our Terms of Service. Please review this Policy and our Terms before using the Sites. By using this Site, you acknowledge the collection, use, disclosure, and other processing of your Personal Information as described in this Privacy Policy. If you do not agree with this Privacy Policy, do not access or use the Sites.

NOTICE TO U.S. STATE RESIDENTS

Notice at Collection

We collect Personal Information as detailed in this Privacy Policy. This section is intended to serve as a notice at collection and state-specific privacy disclosure for residents of states with applicable comprehensive consumer privacy laws, including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, and any other state privacy law that applies to our processing activities.

Depending on your state of residence and our relationship with you, you may have rights to access, correct, delete, obtain a copy of, or opt out of certain processing of your Personal Information. As defined by applicable law, we may “sell” or “share” certain Personal Information or process Personal Information for “targeted advertising.” If you would like to opt out of the sale or sharing of your Personal Information or targeted advertising, you may do so here. You may also choose to enable, where available, a universal opt-out mechanism that automatically communicates your opt-out preferences, such as the Global Privacy Control (“GPC”). Where required by applicable law, we will process such signals as a request to opt out of sale, sharing, or targeted advertising for that browser or device.

We keep Personal Information as long as it is necessary or relevant for the practices described in this Privacy Policy, including to provide the Sites, complete transactions, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, and maintain security. What this means in practice will vary between different types of information, and when we consider our approach we take into account ongoing business or legal needs for the information, including tax, health and safety, regulatory, dispute, and investigation requirements.

We collect your Personal Information as disclosed in the “Collection of Information” section below.

DEFINITIONS

For purposes of this Privacy Policy:

“Aggregate or De-Identified Information” means information that does not identify and cannot reasonably be used to identify an individual. We maintain and use de-identified information only in de-identified form and will not attempt to re-identify it except as permitted by applicable law.

“Cookies” means unique identifiers that a website places on the hard drive of your computer or mobile device when you visit the website. Cookies may involve the transmission of information from us to you and from you directly to us, to another party on our behalf, or to another party in accordance with its privacy policy.

“Flash Cookies” means local shared objects that are used to store personalized information based on visits to websites.

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household. Depending on applicable law, Personal Information may include personal data, sensitive personal information, or sensitive personal data.

“Sensitive Personal Information” means Personal Information that is treated as sensitive under applicable law, which may include precise geolocation data, racial or ethnic origin, religious beliefs, mental or physical health diagnosis, sex life or sexual orientation, citizenship or immigration status, genetic or biometric data processed for the purpose of uniquely identifying an individual, Personal Information collected from a known child, account log-in credentials, financial account information with access credentials, or other information designated as sensitive by applicable law.

“Sale,” “share,” “targeted advertising,” and “profiling” have the meanings given to them under applicable state privacy laws.

“Web Beacons” means small pieces of data that are embedded in images on the pages of Sites. Web beacons may involve the transmission of information directly to us, to another party on our behalf, or to another party in accordance with its privacy policy.

2. COLLECTION OF INFORMATION

We collect information in different ways. We collect information listed in the “What Categories of Information We Collect About You” section below when you provide us that information voluntarily. For example, if you register an account with us, contact us for information, complete an assessment, make a purchase, subscribe to marketing communications, or participate in a promotion.

We also collect information about you automatically. Where permitted by law, we use tracking tools such as browser Cookies, Web Beacons, pixels, tags, software development kits, and similar technologies to collect information from you. We collect information about users over time when they use the Sites and may collect information across different websites, apps, and devices. We collect information about you from third parties, such as social media platforms, advertising networks, analytics providers, data aggregators, data brokers, public or commercially available databases, affiliates, business partners, and service providers. We may have third parties collect information as described in this Privacy Policy, including in Section 5.

What categories of Personal Information do we collect? What are the purposes for which we collect and use your Personal Information?
  • Identifiers, such as name, postal address, email address, telephone number, account name, Internet Protocol address, device identifiers, and similar identifiers.
  • Customer Records Information, such as billing address, shipping address, payment information, and customer service records.
  • Characteristics of Protected Classifications, such as age range or other demographic information where you provide it or where permitted by law.
  • Commercial Information, such as products or services purchased, obtained, considered, returned, or reviewed, shopping cart activity, loyalty or rewards activity, and purchasing or consuming histories or tendencies.
  • Internet or Other Electronic Network Activity Information, such as browsing history, search history, device information, browser type, operating system, referring URLs, pages viewed, links clicked, and interactions with our Sites, applications, emails, advertisements, or social media pages.
  • Geolocation Data, such as approximate location derived from IP address or, where enabled and permitted by law, more precise location information.
  • Audio, Electronic, Visual, or Similar Information, such as call recordings, voicemail, chat transcripts, photographs, or video you choose to provide.
  • Professional or Employment-Related Information, such as information you submit through career, professional, or business contact features.
  • Inferences, such as preferences, characteristics, interests, product recommendations, and similar profiles or predictions based on the information described above.
  • Sensitive Personal Information, such as account credentials, payment information with security credentials, precise geolocation if enabled, health or wellness information you choose to provide in assessments or interactive tools, and information relating to children where permitted and handled as required by law.
  • To respond to your requests, questions, purchases, returns, and customer service inquiries.
  • To provide, maintain, personalize, troubleshoot, and improve our Sites, products, programs, promotions, and services.
  • To process transactions, fulfill orders, administer accounts, loyalty or rewards programs, sweepstakes, contests, surveys, assessments, and other interactive features.
  • To provide personalized recommendations, content, advertising, and offers, subject to your choices and applicable law.
  • To conduct analytics, research, measurement, product development, internal operations, and business planning, including by using aggregated or de-identified information.
  • To detect, investigate, prevent, or respond to security incidents, fraud, unlawful activity, policy violations, or misuse of the Sites.
  • To communicate with you about your account, purchases, our relationship, policy updates, product recalls, safety notices, and other transactional or administrative matters.
  • To comply with applicable law, legal process, regulatory obligations, and rights requests, and to establish, exercise, or defend legal claims.

3. USE OF INFORMATION

We may use the information we collect from and about you for a variety of business and commercial purposes, including:

Fulfilling Your Requests. We use Personal Information to respond to your requests or questions, complete transactions, process purchases and returns, provide customer service, administer accounts, and provide requested products, services, assessments, promotions, or interactive features.

Providing and Improving Our Sites. We use Personal Information to administer, maintain, troubleshoot, test, protect, and improve our Sites, products, programs, and services. We may aggregate or de-identify information for analytics, research, product development, business planning, and other lawful purposes.

Personalization and Recommendations. If you choose to complete assessments or use personalized features, we may use information you provide to send personalized product recommendations, content, or other information that we believe may be of interest to you. We may remember account, login, preference, and shopping cart information so that you can more easily use the Sites.

Marketing and Targeted Advertising. We may use Personal Information to send you promotional messages, tell you about products, services, offers, features, or updates, measure marketing effectiveness, and serve advertising that may be more relevant to your interests. Where required by applicable law, you may opt out of sale, sharing, targeted advertising, or certain profiling as described in the “Your Privacy Rights” section.

Third-Party Social Networks. We may use Personal Information when you interact with third-party social networking features, such as “Like” functions, to engage with you on third-party social networks and to support advertising or measurement. Security, Fraud Prevention, and Legal Protection. We use Personal Information to help prevent, detect, investigate, and respond to fraud, security incidents, unlawful activity, policy violations, and misuse of the Sites; to enforce our agreements; and to protect our rights, privacy, safety, property, and the rights, privacy, safety, and property of others.

Managing and Operating Our IT Systems. We use Personal Information to troubleshoot, test, maintain, secure, and improve our information technology systems, including our Sites.

Complying with Legal and Regulatory Obligations. We use Personal Information to comply with legal and regulatory obligations, respond to legal process, process privacy rights requests, keep required records, and communicate product recall or safety information.

Sensitive Personal Information. We use Sensitive Personal Information only as reasonably necessary and proportionate for the purposes permitted by applicable law, including to provide requested goods or services, ensure security and integrity, prevent fraud, process payments, fulfill assessments or other features you choose to use, comply with law, or as otherwise with your consent where required. We do not use Sensitive Personal Information to infer characteristics about you except as permitted by applicable law.

4. DISCLOSURE AND SHARING OF INFORMATION.

Affiliates. We are affiliated with a number of other health and wellness brands (collectively, our “Affiliates”). We may share your Personal Information with our Affiliates to provide our Sites, support business operations, send you promotions, information about sales and offers, and newsletters in which you have indicated interest, and for legal, security, analytics, and other business purposes.

Business Partners. We may share your Personal Information with companies with whom we partner to offer goods or services, joint products or promotions, co-branded offerings, loyalty or rewards programs, or other business relationships.

Service Providers and Processors. We may disclose Personal Information to third-party service providers, contractors, and processors that perform services for us, such as website hosting, payment processing, order fulfillment, shipping, customer service, job application support, website analytics, email and communications services, marketing assistance, data analysis, fraud prevention, security, IT support, and other administrative services. These recipients are authorized to use Personal Information only as needed to provide services to us or as otherwise permitted by applicable law.

Analytics and Advertising Partners. We may disclose or make available Personal Information to analytics providers, advertising networks, advertising platforms, social media companies, and other partners to support advertising, measurement, attribution, personalization, and analytics. Depending on applicable law, some of these activities may constitute a “sale,” “sharing,” or processing for “targeted advertising.” You may opt out as described in this Privacy Policy.

Sponsors or Administrators. We may offer sweepstakes, contests, and other promotions (collectively, a “Promotion”) that may require registration. By participating in a Promotion, you are agreeing to the official rules that govern that Promotion, which may contain specific requirements, including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing associated with the Promotion. If you choose to enter a Promotion, your Personal Information may be disclosed to third parties or the public in connection with administration of the Promotion, including winner selection, prize fulfillment, and as required by law or permitted by the Promotion's official rules, such as on a winners list.

We may also disclose your Personal Information: i) as required by law, such as to comply with a subpoena or similar legal process; ii) when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, prevent harm, or respond to a valid government request; or iii) in connection with an actual or proposed merger, acquisition, assignment, divestiture, bankruptcy, consolidation, reorganization, liquidation, transfer, or sale of all or a portion of our assets

5. COOKIES AND OTHER TRACKING TECHNOLOGIES

We collect information, and authorize third-party vendors to collect information, about users over time across our Sites and other websites, applications, and services. To do this, we and/or our third-party vendors use tracking tools such as Cookies, Web Beacons, Flash Cookies, pixels, tags, software development kits, and similar technologies.

We may work with email delivery and marketing companies to send emails that you have agreed to receive. Pixel tags and cookies may be used in those email messages and on our Sites to help us measure the effectiveness of our advertising, understand how visitors use our Sites, and provide more focused and subsequent marketing communications.

Some content or applications, including advertisements, on the Sites are served by third parties, including advertisers, ad networks and servers, content providers, application providers, analytics providers, and social media platforms. These third parties may use cookies alone or in conjunction with Web Beacons or other tracking technologies to collect information about you when you use our Sites. The information they collect may be associated with your online activities over time and across different websites, applications, devices, and online services. They may use this information to provide interest-based advertising, targeted advertising, cross-context behavioral advertising, measurement, analytics, attribution, or other targeted content.

While we may use a variety of service providers and partners to perform advertising services, some of these companies are members of the Network Advertising Initiative (“NAI”) or the Digital Advertising Alliance (“DAA”) Self-Regulatory Program for Online Behavioral Advertising. Where required by applicable law, we recognize universal opt-out mechanisms, such as GPC, as requests to opt out of sale, sharing, or targeted advertising for the browser or device that sends the signal. Because these signals are browser- or device-specific, you may need to enable the signal on each browser or device you use.

6. SECURITY AND RETENTION

Nature’s Way has reasonable technical and organizational security measures in place to protect Personal Information under our control against loss, misuse, unauthorized access, disclosure, alteration, and destruction. However, given the nature of technology, we cannot guarantee that our systems are 100% secure. We periodically update our technology and practices to improve the protection of customer information.

We retain Personal Information for as long as it is reasonably necessary and proportionate to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. In determining retention periods, we consider the nature and sensitivity of the information, the purposes for which we process it, the length of our relationship with you, applicable legal requirements, tax, accounting, product safety, recall, fraud prevention, security, dispute, and investigation needs, and whether the information has been aggregated or de-identified.

7. WE STORE INFORMATION BOTH IN AND OUTSIDE OF THE U.S.

Personal Information we collect from you may be transferred to, stored in, or processed in the United States or another destination outside of the United States. It may be processed by staff operating in these locations who work for us or for one of our service providers or suppliers. Such staff may be engaged in, among other things, payment processing, order fulfillment, customer service, Site operations, and support services. If you live outside of the United States, you understand that U.S. laws may not afford the same level of protection as those in your country.

8. CHANGES TO PRIVACY POLICY

Nature’s Way may make changes to this Privacy Policy from time to time. We will post changes to our Privacy Policy here and update the “Last Modified” date when we make material changes. Your continued use of the Sites after an updated Privacy Policy is posted means that you acknowledge the updated Privacy Policy to the extent permitted by law.

9. UNSUBSCRIBING FROM MARKETING MESSAGES

You may unsubscribe from receiving offers and promotions for our products and services through the unsubscribe mechanisms provided in our promotional communications. Even if you opt out of marketing messages, we may still send transactional, administrative, legal, product safety, recall, or relationship messages, including responses to your questions.

10. OUR SITES AND CHILDREN

Our Sites are meant for adults and are not directed to children under the age of 16. We do not knowingly collect Personal Information from children under 16 without appropriate consent where required by law. We do not knowingly sell or share Personal Information of children under 16 or use such information for targeted advertising. Explanation of Applicable Privacy Rights

Depending on your state of residence and applicable law, you may take advantage of the following privacy rights:

  • Right to Know/Access: You may have the right to request that we confirm whether we process your Personal Information and provide access to Personal Information we have collected about you, including categories of Personal Information, categories of sources, purposes for collection, use, sale, sharing, or targeted advertising, categories of third parties to whom we disclose Personal Information, and, where required, the specific pieces of Personal Information we have collected about you.
  • Right to Delete: You may have the right to request that we delete Personal Information that we have collected from or about you, subject to certain exceptions. We may retain information as permitted by law, including to complete transactions, detect and prevent fraud, protect security, comply with legal obligations, exercise or defend legal claims, or maintain internal records.
  • Right to Correct: You may have the right to request that we correct inaccurate Personal Information that we maintain about you, taking into account the nature of the Personal Information and the purposes of processing.
  • Right to Opt Out of Sale, Sharing, Targeted Advertising, or Certain Profiling: You may have the right to opt out of the sale of Personal Information, sharing of Personal Information for cross-context behavioral advertising, processing of Personal Information for targeted advertising, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
  • Right to Limit or Withdraw Consent for Sensitive Personal Information: Depending on applicable law, you may have the right to limit the use and disclosure of Sensitive Personal Information, withdraw consent for certain processing of Sensitive Personal Information, or request that we not process Sensitive Personal Information except as permitted by law.
    • Right to Data Portability: You may have the right to obtain a copy of Personal Information you previously provided to us in a portable and, to the extent technically feasible, readily usable format.
  • Right to Appeal: Where required by applicable law, you may appeal our decision if we decline to take action on your privacy rights request. We will explain how to submit an appeal in our response to your request.

If by email, please indicate the type of request you are making in the subject line of your message. We may request certain information to verify your identity before we can respond to such requests. We will respond to verified requests within the time required by applicable law. If we need additional time, we will let you know as permitted by law.

To take advantage of your right to opt out of the sale or sharing of Personal Information or targeted advertising, please click on the Do Not Sell or Share My Data link which also is on our site footer or contact us using the “Contact Us” section below. We will process opt-out requests within the time required by applicable law.

Where required by applicable law, you may also choose to enable a universal opt-out mechanism, such as the Global Privacy Control (“GPC”), that automatically communicates your opt-out preferences. We will process supported universal opt-out signals as requests to opt out of sale, sharing, or targeted advertising for the browser or device that sends the signal.

We will not discriminate against you because you exercised rights under this Privacy Policy. For example, we will not deny goods or services, charge different prices, provide a different level or quality of goods or services, or suggest that you may receive a different price or quality of goods or services because you exercised your rights, except as permitted by applicable law.


Agent Requests

You may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you have authorized them to act on your behalf or must demonstrate they have power of attorney as required by applicable law. We retain the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the consumer’s identity and the agent’s authority. An authorized agent is prohibited from using a consumer’s Personal Information, or any information collected from or about the consumer, for any purpose other than to fulfill the consumer’s requests, verification, or fraud prevention. We have collected the categories of Personal Information disclosed in the “Notice to U.S. State Residents” section above, including within the last twelve (12) months.

We Obtain the Categories of Personal Information Listed above from the following categories of sources:

  • Directly from you. For example, when you sign up for email on our Site.
  • From other sources, such as marketing partners, social events, and social networking sites.
  • Automatically through the use tracking technologies, as disclosed in the “Cookies and Other Tracking Technologies” section.


We collect Personal Information for the business and commercial purposes described in the “Use of Information” section above.

Categories of Personal Information Disclosed for Business Purposes:

We may disclose your Personal Information to a third party for a a business purpose. When we disclose Personal Information for a business purpose, we require recipients to protect Personal Information and use it only for the purposes for which we disclosed it or as otherwise permitted by applicable law.

We disclose your Personal Information for the business purposes disclosed above in “Use of Information” to the following categories of third parties:

  • Our Affiliates.
  • Service providers. We engage certain third parties to perform functions and provide services to us, including direct marketing campaigns. We may share your Personal Information with these third parties, only to the extent necessary to perform these functions and provide such services. We also require these third parties to maintain the privacy and security of the Personal Information they process on our behalf.

In the preceding twelve (12) months, we may have sold, shared, or processed for targeted advertising the following categories of Personal Information: identifiers, commercial information, Internet or other electronic network activity information, geolocation data, and inferences. We may have disclosed these categories to analytics and advertising partners, business partners, advertising networks, advertising platforms, social media companies, and other third parties for the purposes described in this Privacy Policy, including targeted advertising, cross-context behavioral advertising, measurement, attribution, analytics, and personalization. We do not knowingly sell or share Personal Information about persons under the age of 16.


Data Protection Assessments and Automated Decision-Making

Where required by applicable law, we conduct and maintain data protection assessments for processing activities that present a heightened risk of harm, such as targeted advertising, sale of Personal Information, processing of Sensitive Personal Information, or certain profiling activities. We do not use automated decision-making or profiling to make decisions that produce legal or similarly significant effects concerning you unless disclosed and permitted by applicable law.
